Italy Faces EU Procedure Over Presumption of Innocence

Brussels: The European Commission announced that it is initiating infringement proceedings against Italy due to alleged non-compliance with the EU directive aimed at bolstering the presumption of innocence and the right to be present during trial in criminal proceedings.

According to Ansa News Agency, the Commission identified that Italy failed to appropriately incorporate the provisions regarding limitations on the use of physical restraint in public. Additionally, concerns were raised about the right to silence and the protection against self-incrimination, particularly in situations where investigating authorities collect information at crime scenes or immediately following an offence. The directive also addresses instances where suspects provide spontaneous statements.

This action underscores the European Commission’s commitment to ensuring all member states adhere to established legal standards, particularly concerning fundamental rights in criminal proceedings.
