EU Consultation on Digital Regulation Revision, AI Focus

Brussels: As part of the review of the European Digital Markets Act (DMA), the European Commission has published a call for contributions and a questionnaire on artificial intelligence (AI) to “identify potential areas for improvement” in the law and “take into account emerging challenges, such as the introduction of AI-based services.” This is the first review of the DMA that the Commission is required to conduct by May 3, 2026, and every three years thereafter.

According to Ansa News Agency, the aim of the review is to assess the extent to which the law’s provisions contribute to the objective of ensuring contestable and fair markets and their impact on business users, particularly SMEs, and end users. The review, on which an initial public consultation was launched on July 3, should also assess whether additional measures are needed to ensure the effectiveness of the DMA.

Based on the contributions received, the Commission will prepare an impact assessment report on the DMA, which will be submitted to the European Parliament, the Council, and the European Economic and Social Committee. The consultation will remain open until September 24, 2025.

The DMA is one of the cornerstones of European digital legislation aimed at ensuring that no large online platform acts as a “gatekeeper,” i.e., a private player that can set the rules on digital markets by controlling at least one of the so-called core platform services, including online intermediation services (marketplaces, software application stores); online search engines; social networking services; cloud services; and advertising services.
